Cosmo — Terms of Use

Version 1.2 · Effective [to be completed: effective date]

Draft for legal review. This text was written to describe the product accurately. It has not been reviewed or certified by a lawyer. Items marked [OWNER REVIEW] must be completed or confirmed by the owner before public release.

1. Who we are

Cosmo ("Cosmo", "the software") is a desktop companion for Windows developed by hackerlumu ("we", "us"). Contact: [to be completed: contact e-mail or address].

By installing or using Cosmo you agree to these Terms of Use. If you do not agree, do not install or use Cosmo.

2. Licence and permitted use

Cosmo is licensed, not sold. Your rights are set out in the licence installed with Cosmo (LICENSE.txt). In summary:

[to be completed: confirm whether business use, redistribution or other uses are permitted, and keep this section and LICENSE.txt consistent.]

3. Third-party and open-source material

Cosmo includes software and material from others, including code derived from Coucou by Louis Raillé under the MIT License, assets used with permission, and open-source components. That material stays under its own licences, listed in THIRD_PARTY_NOTICES.txt (installed with Cosmo and shown in Settings › About › Legal). Where those licences differ from these Terms for that material, those licences apply.

4. Optional AI providers

Cosmo works without any AI service. If you choose to connect an AI provider (for example OpenAI, Anthropic, Google Gemini, OpenRouter, or a compatible endpoint you configure):

"Cosmo AI" (a hosted option) is not available in this version.

5. Other third-party services and tools

Cosmo can work with tools you already use, such as Claude Code, Codex and Windows media sessions. Those tools are provided by their own publishers under their own terms. Cosmo shows information those tools and Windows make available; it does not guarantee that information is complete or accurate.

6. Information shown by Cosmo

Media, network, battery, focus, game and coding-activity information is shown for convenience. It can be delayed, incomplete or wrong. For example, some browsers do not tell Windows whether they are playing music or video. Do not rely on Cosmo for safety-critical, financial or security decisions.

7. Your responsibilities

You are responsible for:

Cosmo never approves a coding-agent permission on its own. Approvals happen only when you click.

8. Updates and availability

Cosmo can check once a day whether a newer version exists (you can turn this off in Settings › Privacy); a new version is installed only when you choose to install it, after its signature is checked. Copies of Cosmo not obtained from its official website may not update. We may change, suspend or stop providing Cosmo or any feature at any time. We do not guarantee uninterrupted or error-free operation.

9. No warranty

COSMO IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, HACKERLUMU IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR BUSINESS, ARISING FROM OR RELATED TO COSMO OR ITS USE, INCLUDING THE USE OF THIRD-PARTY AI PROVIDERS. [to be completed: liability cap and consumer-law carve-outs for the countries where Cosmo is offered.]

Nothing in these Terms limits rights you have under laws that cannot be limited by contract.

11. Intellectual property

Cosmo's original work, including its name, character design, icons, sounds and interface, belongs to hackerlumu or is used with permission. Third-party material belongs to its owners. These Terms do not grant you any trademark rights.

12. Termination

You may stop using Cosmo at any time by uninstalling it. Your licence ends automatically if you break these Terms; you must then stop using and uninstall Cosmo.

13. Changes to these Terms

We may update these Terms. If a change is material, Cosmo will ask you to accept the new version before you continue. Small corrections, such as typos, do not require new acceptance.

14. Governing law

[to be completed: governing law and courts — not yet chosen. Do not publish until completed.]

15. Privacy

How Cosmo handles information is described in the Privacy Notice (version 1.9), shown alongside these Terms.
